FREQUENTLY ASKED

Which lawyers in Murcia handle employment and immigration (visas) in English?
RCM Legal advises companies and individuals on Spanish employment law — contracts, dismissals, senior-executive relationships and restructurings (ERE/ERTE) — and on immigration for non-EU nationals, including work and residence permits, the digital nomad visa and routes for entrepreneurs and highly qualified professionals, in Spanish and English, from Murcia.
What is the difference between an ERE and an ERTE?
An ERE (Expediente de Regulación de Empleo) involves the permanent termination of contracts for economic, technical, organisational or production reasons. An ERTE (Expediente de Regulación Temporal de Empleo) is the temporary suspension of contracts or reduction of working hours, designed for transitory situations. Both require a consultation period with the workforce representatives and impose substantive and procedural requirements whose breach leads to nullity. The choice between the two is strategic and depends on the diagnosis of the underlying situation.
What visa options do non-EU investors and professionals have in Spain now that the Golden Visa has been abolished?
The investor Golden Visa (residence by real-estate or capital investment) was abolished by Organic Law 1/2025 and ceased to exist on 3 April 2025; it is no longer available for new applicants. Non-EU nationals who want to live and work in or from Spain now use the ordinary routes: the digital nomad visa (for remote workers and teleworkers of foreign companies, under the Startups Law), the entrepreneur visa (for innovative business projects of economic interest), the highly qualified professional authorisation and EU Blue Card, the non-lucrative visa (for those with sufficient means who will not work in Spain) and ordinary work and residence permits. We assess each client's activity, income and family plans and choose the route that fits.
What are the consequences of an unfair dismissal finding?
A judicial finding of unfair dismissal gives the employer two options within five days: reinstatement of the employee — with payment of the salaries lost during the proceedings (salarios de tramitación) — or compensation of 33 days of salary per year of service, capped at 24 monthly payments (45 days per year, capped at 42 monthly payments, for service prior to 12 February 2012). The choice corresponds to the employer, except in the case of a worker representative, who chooses themselves. A well-drafted settlement agreement can reduce the exposure substantially before reaching the court.
