Obtaining residence in Murcia: what has changed and how we help

The reform of the Immigration Regulations has made roots residence more accessible and digitised the procedures. But theory and practice do not always match. We explain the key points and how we handle them.

Regularising your situation in Spain has become, on paper, simpler. The entry into force of the new Immigration Regulations has made roots residence (arraigo) more accessible and is driving the digitisation of procedures. In practice, getting an appointment and assembling the documentation correctly remains the real obstacle. These are the key points for those living in the Region of Murcia.

The new Immigration Regulations

Royal Decree 1155/2024 of 19 November, which approves the new Regulations implementing Organic Law 4/2000, entered into force on 20 May 2025 and has substantially reorganised residence authorisations on exceptional grounds. Its stated aim is to speed up processing, unify criteria across the different Immigration Offices and reduce the uncertainty generated by the previous practice.

Roots residence: more accessible and with five forms

The reform reduces, as a general rule, the required period of residence from three to two years and relaxes the financial means accepted. There are now five forms, each with its own requirements:

  • Social roots (arraigo social), for those who can prove ties in Spain and, normally, an employment contract or sufficient means.
  • Socio-labour roots (arraigo sociolaboral), linked to a proven prior employment relationship.
  • Family roots (arraigo familiar), for family members of Spanish citizens or of residents.
  • Socio-educational roots (arraigo socioformativo), tied to a training commitment that improves employability.
  • Second-chance roots (arraigo de segunda oportunidad), for those who once held an authorisation and lost it.

Choosing the right route from the outset saves months of processing.

More digital procedures… and harder appointments

The authorities are moving towards an online system intended to unify criteria and reduce in-person visits. It is a good direction, but today the bottleneck is still the immigration appointment and documentation that, if filed incomplete or poorly translated, is returned and delays the whole file. The meaning of administrative silence and the decision deadlines mean that a flawed approach is costly.

The mistakes that delay a file most

  • Choosing the wrong form of roots residence for the specific case.
  • Submitting foreign documentation without legalisation or apostille and without a sworn translation where required.
  • Failing to properly prove financial means or integration.
  • Letting deadlines lapse by not keeping track of renewals, with the risk of returning to irregularity.
